The opportunity

We are seeking a Competition / Litigation Lawyer with 2–6 years’ post-admission experience to join our Melbourne (preferably) or Sydney office.

This role would suit a strong commercial litigator who is interested in broadening their practice into competition, consumer, regulatory and intellectual property law. Previous competition law experience is welcomed but not essential. We are looking for candidates with strong litigation fundamentals, intellectual curiosity and a genuine interest in how businesses, markets and regulators operate.

The work is fast paced, varied and rarely routine. You may spend one day responding to an ACCC investigation or preparing for complex litigation and the next advising on a significant acquisition, an advertising campaign, a product recall, intellectual property disputes or an emerging compliance issue. Matters are often novel, commercially significant, subject to media scrutiny and closely connected to our clients’ broader business objectives.

We act for some of Australia’s most iconic retailers, including Mecca, Peter Alexander, Smiggle, Retail Food Group, Myer, Kogan, Whitefox, Ultraviolette, Spotlight, Anaconda, just to name a few. We typically deal directly with the owners of these brands, as trusted advisors and as strategic partners, on their most sensitive and high-profile matters. You will gain direct and immediate exposure to our clients.

In addition, you will be heavily involved in dealing with multiple regulators including ACCC, ASIC and ACMA.

You will work closely with partners Zaven Mardirossian and Matthew Lees,



as well as experienced Partners and lawyers across our Litigation and Corporate and M&A; practices. Our teams are lean and collaborative, giving you direct client exposure and the opportunity to learn directly from partners, hone your skills as a lawyer, contribute to strategy and be involved at every stage of a matter. As your experience develops, you will be encouraged to take ownership of significant aspects of matters.

Your work will include a wide variety of important matters such as:

- acting in complex commercial litigation and disputes involving competitors, suppliers, franchisees, consumers and other commercial parties;
- responding to ACCC, ASIC, ACMA and other regulatory investigations and acting in enforcement proceedings;
- advising on consumer law matters, including misleading or deceptive conduct, unconscionable conduct, unfair contract terms, product warranties and consumer guarantees;
- advising on the competition aspects of mergers, acquisitions, joint ventures and other commercial arrangements;
- assessing transactions under Australia’s merger control regime, including the new mandatory merger clearance regime, and preparing notifications, submissions and supporting materials for the ACCC;
- acting in ACCC investigations and enforcement proceedings involving cartel conduct, misuse of market power and other alleged anti-competitive conduct;
- advising on consumer law matters, including misleading or deceptive conduct, unconscionable conduct, unfair contract terms, product warranties and consumer guarantees;
- acting in competition and consumer law disputes, class actions and proceedings involving competitors, suppliers, franchisees and consumers;
- advising on product safety and recalls, including engagement with regulators and other participants in the supply chain;
- advising on high-profile advertising, marketing campaigns, television and online content and compliance issues
- assisting clients to develop competition and consumer law compliance programs and delivering tailored training;




- advising on advertising, marketing campaigns, online content and brand protection; and
- acting in trademark, copyright, patent and other intellectual property disputes.

This is an opportunity to develop a broad and sophisticated competition practice while working on matters with tangible impact on clients’ businesses and commercial objectives.

About You

You are an intellectually curious and commercially minded lawyer who enjoys working through complex legal, factual and strategic issues. You are interested in developing a practice that combines litigation with competition, consumer, intellectual property and regulatory work.

You are looking for a role in which you can work closely with clients and partners, contribute to strategy and take real ownership of your matters.

You will have

- 2–6 years’ post-admission experience, ideally gained in commercial litigation or regulatory matters in private practice;
- an interest in competition and consumer law, with previous experience in those areas viewed favourably but not required;
- solid analytical skills and the ability to identify and address key legal, economic and commercial issues;
- excellent drafting and communication skills;
- sound commercial judgement and the ability to translate complex issues into clear and practical advice;
- confidence engaging with clients and regulators;
- the ability to manage matters independently with appropriate supervision;
- a proactive and adaptable approach, including a willingness to engage with unfamiliar industries and issues; and
- a collaborative working style.
