Whether based in Broome or working under an agreed work‐from‐home arrangement, you must be visible, responsive and prepared to travel across the Kimberley, attend Board meetings and the AGM, and undertake some out‐of‐hours work. Above all, you will lead with integrity, sound judgement and genuine commitment, creating a culturally safe and accountable organisation that Nyul Nyul people can have confidence in.
About us
Nyul Nyul PBC Aboriginal Corporation RNTBC (NN PBC) is an Aboriginal community‐controlled organisation based in Broome, Western Australia. The Corporation supports Nyul Nyul people, members, Directors and community stakeholders to uphold culture, strengthen governance, care for Country, manage organisational operations and pursue social, cultural and economic outcomes for current and future generations.
NN PBC is the Registered Native Title Body Corporate (RNTBC) for the Nyul Nyul native title holders. Under the Native Title Act **** (Cth), the Native Title (Prescribed Bodies Corporate) Regulations **** and the Corporations (Aboriginal and Torres Strait Islander) Act ****, the Corporation manages and protects native title rights and interests on behalf of the native title holders, consults with and obtains the consent of native title holders on native title decisions, responds to future act notices and pursues cultural, land and sea, and economic opportunities on Nyul Nyul country.
About the role
The Executive Officer is responsible for leading the day-to-day operations of the Corporation in accordance with Board direction, the Rule Book, strategic priorities, funding obligations and relevant
legislation. The role provides high-level leadership across governance, finance, programs, people, compliance, stakeholder engagement and organisational development.
Working closely with the Board, members, Traditional Owners, staff, community partners, government agencies and funders, the Executive Officer ensures the Corporation operates in a culturally safe, transparent and accountable way and delivers outcomes that support Nyul Nyul people and community aspirations.
As NN PBC is a RNTBC, the Executive Officer is also responsible for managing the Corporation's native title functions,
including future act responses, agreement negotiations, cultural heritage and the consultation and consent processes that native title decisions require. Native title decisions rest with the native title holders and corporate decisions with the Board; the Executive Officer ensures both are properly informed, made and recorded.
Key Responsibilities
Strategic and organisational leadership
Lead implementation of the Corporation's strategic plan, annual operational priorities and Board‐approved initiatives.
Provide timely, well‐informed advice to the Board to support sound decision‐making, risk management and organisational sustainability.
Promote a culturally safe, accountable and high‐performing workplace aligned with the Corporation's purpose, values and community expectations.
Governance, compliance and reporting
Ensure compliance with the Corporation's Rule Book, Board delegations, policies, funding agreements and applicable regulatory requirements, including ORIC and CATSI Act obligations where relevant.
Coordinate preparation of Board and member meeting papers, reports, agendas, minutes, resolutions and follow‐up actions.
Maintain strong systems for records management, risk, insurance, contracts, governance registers, annual reporting and organisational accountability.
Support Directors to understand and meet their duties under the CATSI Act, including managing conflicts of interest and related party benefits, and arrange governance training as needed.
Maintain the member register and ensure ORIC annual reporting and general reports are lodged on time.
Financial, operational and people management
Oversee budgets, financial performance, acquittals, procurement, assets and resources in partnership with finance staff and external advisers.
Manage staff, contractors and service providers, including recruitment, supervision, performance, workforce planning and professional development.
Strengthen operational policies, procedures, systems and internal controls to support efficient and compliant service delivery.
Represent the Corporation professionally with members, Traditional Owners, community, funders, government, partners and other external stakeholders.
Native title, heritage and agreements
Ensure NN PBC meets its functions under the Native Title Act **** (Cth) and the PBC Regulations, including consulting with and obtaining the consent of native title holders before native title decisions are made and ensuring decisions are properly documented and certified.
Manage NN PBC's response to future act notices within statutory timeframes, working with the Kimberley Land Council, legal advisers and proponents.
Lead negotiations for land use, heritage and other agreements (including ILUAS and right to negotiate agreements) on instruction from the Board and native title holders and monitor compliance with agreements once in place.
Oversee cultural heritage management,
including surveys, monitoring and heritage agreements under the Aboriginal Heritage Act **** (WA), in line with Nyul Nyul cultural protocols.
Ensure agreement benefits and fees for service are received, recorded and applied transparently, in line with Board decisions, the Rule Book and any benefit management arrangements.
Pursue economic development, land and sea management and funding opportunities on Nyul Nyul country, including NIAA PBC funding and partnerships with government and industry.
Selection Criteria
Demonstrated senior leadership or executive management experience in an Aboriginal community‐controlled organisation, not‐for‐profit, PBC, corporation or comparable complex environment.
Solid understanding of Aboriginal culture, community governance, cultural protocols and the importance of Aboriginal self‐determination and Traditional Owner decision‐making.
Demonstrated experience supporting Boards, preparing high‐quality reports and implementing governance, compliance and risk management systems.
Sound financial management capability, including budgeting, acquittals, funding compliance, procurement oversight and financial reporting.
Proven ability to manage staff, build organisational capability and establish clear systems, policies and procedures.
Excellent written and verbal communication skills, including the ability to explain complex information clearly and appropriately to Directors, members and community stakeholders.
High level of integrity, judgement, confidentiality and professionalism, with the ability to manage competing priorities in a regional setting.
Knowledge of the native title system, including the Native Title Act **** (Cth), the PBC Regulations and the future act regime, with experience in (or demonstrated ability to quickly develop capability in) negotiating agreements with government or industry.
Relevant tertiary qualification in the management, governance, business, community development, law, finance or related field, or equivalent senior‐level experience.
Licences and accreditation:
Australian citizenship; permanent residency or a current right to work in Australia.
Current WA Driver's Licence, with capacity to travel regionally as required.
National Police Clearance, or ability to obtain and maintain one.
Working with Children Check, or ability to obtain and maintain one.
Experience working with Aboriginal Corporations registered under the CATSI Act, PBCs, native title representative bodies or Aboriginal-based organisations.
Relevant qualifications in Law, Business Administration, Community Development or equivalent.
Knowledge of native title, heritage, land management, community development, grants management or regional service delivery.
Local knowledge of Broome, the Dampier Peninsula and Kimberley stakeholder networks.
Remuneration
A competitive remuneration package can be negotiated, plus 17.5 % annual leave loading, 12% superannuation and any applicable regional or district allowances, housing, vehicle.
This role can be based in Broome or a remote working from home arrangement anywhere in Australia with travel a few times a year for key meetings and the AGM to Broome.
