Position Overview n
We are seeking an experienced Senior Legal & Compliance Manager to join the legal and compliance team of a growing Australian non-bank lender providing consumer credit products. This is a hands-on role supporting the business to meet its obligations under an Australian Credit Licence (ACL) and providing practical legal and compliance advice across operations, product, customer matters, marketing and growth initiatives.

The successful candidate will be a qualified lawyer or a compliance professional with at least five years' relevant experience in legal, compliance or regulatory roles. Prior experience within an Australian financial services organisation operating under an ACL and/or AFSL is highly desirable.

This role reports to the General Counsel and Chief Compliance Officer.
Key Responsibilities Legal Advice n
n
- Provide practical legal advice in relation to the National Consumer Credit Protection Act 2009 (Cth), National Credit Code, ASIC Act 2001 (Cth), Responsible Lending requirements and relevant ASIC Regulatory Guides.
n
- Advise on privacy, data handling and direct marketing obligations, including under the Privacy Act 1988 (Cth), Australian Privacy Principles and Spam Act 2003 (Cth).
n
- Draft, review and negotiate third-party commercial contracts with third party service providers, technology vendors, referral and marketing partners.
n
Compliance Framework & Incidents nn
- Manage and continuously improve the compliance framework applicable to an ACL holder, including policies, procedures, registers, monitoring programs and controls.
n
- Undertake compliance reviews and assessments across business processes, products and customer journeys; identify gaps and work with stakeholders to implement remediation.
n
- Manage legal and compliance incidents end-to-end, including identification, investigation and root-cause analysis, assessment of customer and regulatory impact, rectification, remediation, corrective actions and closure.
n
- Undertake breach assessments and advise on ASIC breach reporting.
n
Complaints, Privacy & AML/CTF Matters nn
- Provide legal and compliance support on complaints, hardship, collections, vulnerable customer and other complex customer matters, including identification of systemic issues.
n
- Support privacy incidents and data breaches, including assessment, investigation and regulatory/customer notification where required.
n
- Provide advice and support on AML/CTF obligations and the maintenance and implementation of the AML/CTF framework, including customer due diligence, transaction monitoring, escalation and reporting requirements.

Product, Marketing, & Regulatory nn
- Provide legal and compliance advice on new products, product changes, pricing, fees, customer journeys, process changes and other strategic or growth initiatives.

- Review marketing collateral, advertising, campaigns, promotions and customer communications to ensure compliance with ASIC Regulatory Guide 234.
n
- Liaise with ASIC, AFCA, AUSTRAC and other regulators as required including responding to notices, information requests and regulatory enquiries.

- Monitor and advise on relevant legal and regulatory developments.

Qualifications & Experience nn
- At least five years' relevant professional experience in legal, regulatory, or compliance or a combination of these areas.
n
- Prior experience with an Australian financial services organisation or consumer credit lender.
n
- Ideally admitted as a lawyer in an Australian jurisdiction or possesses strong prior compliance experience.
n
- Prior experience managing or supporting a compliance framework in a regulated financial services environment, including compliance assessments, investigations, breach assessments and remediation is highly regarded.
n
- Experience with complaints, hardship, collections, product initiatives, marketing review and commercial contracts is highly regarded.
n
- Experience dealing with ASIC, AFCA, AUSTRAC or other Australian regulators is desirable.
n
- Strong knowledge of National Consumer Credit Protection Act 2009 (Cth) and National Credit Code; responsible lending obligations and ASIC Regulatory guides; ASIC Act 2001 (Cth); Privacy Act 1988 (Cth) and Australian Privacy Principles; Spam Act 2003 (Cth); AML/CTF legislation, rules; ASIC breach reporting; IDR/AFCA requirements; and financial hardship and debt collection requirements.
