Legal Counsel / Senior Solicitor - Construction & Commercial n
The primary focus is construction and commercial legal matters, debt recovery and civil litigation. There will also be occasional advisory work for associated hospitality and fitness businesses, including lease reviews and commercial agreements. This opportunity suits an experienced solicitor who can work independently, assess the merits of a dispute and recommend a commercially sensible course of action.
Key responsibilities n

Manage civil and commercial disputes, including contractual claims, debt recovery, building disputes and settlement negotiations.
n
Assess prospects of success, potential exposure, legal costs and recovery options, providing clear recommendations to the Director.
n
Prepare and review letters of demand, pleadings, affidavits, witness statements, submissions and settlement agreements.
n
Manage court and tribunal deadlines, evidence preparation and procedural requirements.
n
Represent the relevant entities in negotiations, mediations and proceedings where appropriate, engaging barristers or external specialists when required.
n
Draft, review and negotiate building contracts, subcontracts, consultancy agreements and supplier terms.
n
Advise on variations, payment claims, extensions of time, defects, delays, suspension and termination.

Advise on applicable security of payment processes and coordinate adjudication matters.
n
Review commercial and retail leases, renewals, guarantees and landlord obligations as required.
n
Develop standard contracts, templates and internal procedures to reduce avoidable disputes.

About you n
n
Admission as an Australian lawyer and a current practising certificate appropriate to the role.
n
Ideally, at least five years' post-admission experience.
n
Demonstrated civil litigation experience, including managing matters through court processes.
n
Strong commercial law experience, with construction and property exposure highly regarded.
n
Experience in debt recovery, contractual disputes, mediation and settlement negotiations.
n
Excellent legal drafting, analytical and negotiation skills.
n
The ability to give clear advice on whether to pursue, defend or settle a matter.
n
Solid organisation and the ability to manage deadlines across multiple entities.
n
Sound judgment regarding confidentiality, conflicts of interest and when specialist advice is required.
