We are seeking an experienced and commercially minded Employment & Workplace Relations Manager to join our Head Office team in Rhodes, NSW.
You will take ownership of the Company's employment and workplace relations portfolio, managing complex employee matters, workplace investigations, Fair Work proceedings, wage compliance matters and employment-related risk from commencement through to resolution.
This is a hands-on role for someone who is comfortable taking responsibility for matters, making sound recommendations and driving outcomes.
About the Role:
You will be responsible for the day-to-day management of employment and workplace relations matters across the business, working closely with the broader People & Culture team, Payroll, Operations and senior leaders.
You will take ownership of matters from initial assessment and investigation through to documentation, lodgement, representation and resolution.
An overview of your responsibilities will include:
- Taking ownership of complex employee relations and workplace relations matters from commencement through to resolution
- Managing disciplinary, misconduct, performance management, grievance and termination processes, including preparing all required documentation
- Conducting and managing workplace investigations, including developing allegations, interviewing employees and witnesses, assessing evidence, preparing findings and recommending appropriate outcomes
- Managing Fair Work Commission matters end-to-end, including unfair dismissal, general protections, stop bullying and other workplace-related applications
- Preparing and lodging employer responses, applications, submissions and supporting documentation with the Fair Work Commission within required timeframes
- Representing the Company at Fair Work Commission conferences, conciliations and other proceedings where appropriate
- Managing Fair Work Ombudsman enquiries, requests for information,
compliance matters and investigations
- Preparing position statements, chronologies, evidence bundles, witness materials, settlement documentation and other employment-related correspondence
- Managing employment-related disputes and claims through to resolution, including settlement negotiations where authorised
- Escalating matters to external legal advisers where appropriate and managing those advisers, costs, instructions and deliverables
- Providing clear recommendations to senior management on employment risk and proposed courses of action
- Taking ownership of Award interpretation and workplace relations compliance matters
- Partnering with Payroll to investigate and resolve wage compliance issues, potential underpayments and Award interpretation matters
- Identifying systemic wage and employment compliance risks and driving appropriate corrective actions
- Managing employment-related aspects of workers' compensation matters, including return-to-work, capacity, performance and employment status issues
- Reviewing and preparing policies, procedures, correspondence and workplace relations documentation
- Monitoring legislative, Award and workplace relations developments and implementing required changes across the business
- Developing practical tools, templates and processes to improve the consistency and quality of employment decisions
- Building the workplace relations capability of managers and the broader People & Culture team through practical guidance and training
- Maintaining appropriate records, case files and reporting across the Company's employment and workplace relations portfolio
About You:
We would love to hear from you if you can confidently demonstrate:
- Approximately 3–6 years' relevant experience in workplace relations, employee relations, employment law, industrial relations or a similar specialist role
- Strong working knowledge of the Fair Work Act, National Employment Standards and Contemporary Awards
- Demonstrated experience independently managing complex disciplinary,
misconduct, performance, grievance and termination matters
- Demonstrated experience conducting or managing workplace investigations
- Practical experience preparing and lodging Fair Work Commission documentation and managing matters through conciliation or other proceedings
- Experience managing unfair dismissal, general protections or other employment-related claims
- Strong drafting skills and the ability to prepare clear, accurate and defensible employment documentation
- Strong analytical capability and the confidence to assess risk, form a position and recommend a course of action
- The ability to take ownership of matters and drive them to completion within strict deadlines
- Confidence dealing directly with employees, managers, unions, regulators, external lawyers and senior executives
- High attention to detail, sound judgement and the ability to manage highly confidential and sensitive matters
- The ability to manage multiple complex and time-critical matters simultaneously
- A practical and commercially focused approach to workplace relations and problem solving
A tertiary qualification in Human Resources, Employment Relations, Industrial Relations, Law or a related discipline will be highly regarded. Candidates with an employment law background are encouraged to apply;
