Treasury's Law Division is looking to fill multiple APS5 and APS6 vacancies in Legislative Drafter and Legislation Designer roles.

About the role

Law Division brings together specialist legislative drafting, law design, legal advice and legal policy expertise to support the development, design and delivery of Treasury's legislative program. Our work includes:

- Designing legislative solutions to implement Government policy decisions, and working with policy divisions, portfolio agencies and Ministers' offices to translate policy into law.
- Drafting legislative instruments and supporting the development of legislation.
- Preparing drafting instructions and working with the Office of Parliamentary Counsel on primary and subordinate legislation.
- Providing advice on legislative drafting, law design, legislative delivery and legal policy issues.
- Supporting the development, delivery and maintenance of Treasury portfolio laws, and regulatory compliance.

Law Division is looking to fill multiple APS5 and APS6 vacancies for Legislative Drafters and Legislation Designers.

Roles may be filled at the APS5 or APS6 level depending on the complexity of the work, degree of judgement, independence and accountability required, and the skills and experience of the successful candidate.

At the APS5 level, employees will generally undertake moderately complex to complex legislative drafting and law design work under limited direction, exercise judgement within their area of responsibility, manage allocated work and priorities, and develop and apply specialist knowledge and skills.

At the APS6 level, employees will generally undertake complex legislative drafting and law design work under limited direction, exercise a greater degree of initiative and judgement, take responsibility for significant or discrete components of legislative projects, provide well-reasoned advice on complex issues, and provide guidance and support to build the development and capability of less experienced team members.

The key duties of the position include:

Legislative Drafters will:

- Draft simpler legislative instruments and other legislative products appropriate to the classification level.
- Undertake legislative research and analysis to support drafting projects and inform drafting approaches.
- Work closely with legislation designers and policy teams to implement Government priorities through legislative instruments.
- Identify and contribute to resolving legislative drafting and delivery issues and assist in developing drafting approaches and options.
- Contribute to editorial, quality assurance and publication processes for legislative instruments.
- Contribute to the planning and delivery of Treasury's subordinate legislation program.
- Develop and apply specialist legislative drafting knowledge and expertise through practical experience, on-the-job learning and coaching.
- Manage allocated drafting work and contribute to timely delivery of legislative projects.

Legislation Designers will:





- Contribute to the design and development of legislative frameworks and solutions to implement Government policy decisions.
- Undertake research and analysis and provide advice on legislative, legal and policy issues.
- Prepare drafting instructions for primary and subordinate legislation appropriate to the classification level.
- Draft explanatory materials to support legislation.
- Support policy development by providing advice on legislative design options and implications.
- Work collaboratively with policy teams, portfolio agencies and other stakeholders to support the development and delivery of legislation.
- Manage allocated work and contribute to the timely delivery of legislative projects.

APS5

APS5 employees will generally undertake moderately complex to complex legislative work under limited direction. They will be expected to exercise judgement within their area of responsibility, organise and manage their workflow, provide well-reasoned advice and take responsibility for the quality and timely delivery of allocated work.

APS5 applicants should be able to demonstrate:

- Experience researching, analysing moderately complex to complex legislative, legal or policy issues and providing clear, well-reasoned advice.
- The ability to exercise sound judgement, identify and contribute to resolving issues, and recognise when escalation is required.
- The ability to manage competing priorities and deliver high-quality work under limited direction.
- Strong written and verbal communication skills, including the ability to communicate complex information clearly and appropriately.
- The ability to develop and apply specialist knowledge in legislative drafting or law design.

APS6

APS6 employees will generally undertake complex legislative work under limited direction and with a greater degree of independence. They will be expected to exercise initiative and sound judgement, take responsibility for significant or complex components of legislative projects, provide high-quality advice and recommendations on complex issues, and contribute to the capability and effectiveness of the team.

APS6 applicants should be able to demonstrate:

- Experience researching and analysing complex legislative, legal or policy issues and providing practical, well-reasoned advice and recommendations.
- The ability to exercise initiative and sound judgement in identifying, analysing and resolving complex issues within their area of responsibility.
- The demonstrated ability to lead or take responsibility for significant or complex components of legislative, policy or drafting projects.




- The ability to manage competing priorities and deliver high-quality work with a high degree of independence under limited direction.
- Robust written and verbal communication skills, including the ability to communicate complex issues clearly and influence outcomes.
- The ability to support, coach and guide less experienced team members and contribute to the development of team capability.

Desirable skills and experience

- Tertiary qualifications in law, public policy, economics, commerce or a related discipline, or equivalent experience.
- Experience working with legislation, legislative instruments, legislative projects or legal policy issues.
- An understanding of the legislative process and the development and implementation of legislation.
- Experience preparing drafting instructions, legislative instruments or explanatory material will be highly regarded.

For the Legislative Drafter roles, experience developing, drafting or reviewing legislation or legislative instruments will be highly regarded.

For the Legislation Designer roles, experience in law design, legal policy or supporting the development of legislative solutions to implement Government decisions will be highly regarded.

Eligibility

Under Section 22(8) of the Public Service Act 1999, employees of the Treasury are required to be Australian Citizens.

Successful candidates will be required to obtain and maintain, at a minimum, a Baseline security clearance, and will be subject to pre-employment screening checks.

Some positions may require a higher level of clearance, as specified in the position description.
