About the role

Law Division brings together specialist legislative drafting, law design, legal advice and legal policy expertise to support the development, design and delivery of Treasury's legislative program. Our work includes:

- Designing legislative solutions to implement Government policy, and working with policy divisions, portfolio agencies and Ministers' offices to translate policy into law.
- Drafting legislative instruments and supporting the development of legislation.
- Preparing drafting instructions and working with the Office of Parliamentary Counsel on primary and subordinate legislation.
- Providing advice on legislative drafting, law design, legislative delivery and legal policy issues.
- Supporting the development, delivery and maintenance of Treasury portfolio laws, and regulatory compliance.

Law Division is looking to fill multiple EL1 vacancies for Legislative Drafters and Legislation Designers.

EL1 employees will generally undertake complex or sensitive legislative drafting and law design work under broad direction. They will exercise a considerable degree of independence, judgement and initiative, and be accountable for leading significant legislative drafting and law design work, providing high-quality advice, managing relationships with key stakeholders and contributing to team capability and broader Law Division priorities.

The key duties of the position include:

Legislative Drafters will:

- Lead the drafting of legislative instruments and other legislative products.
- Undertake complex legislative research and analysis to inform drafting approaches and support the delivery of legislative projects.
- Exercise judgement in identifying and resolving legislative drafting issues and provide high-quality practical advice on drafting approaches, options, risks and implications.
- Work closely with legislation designers, policy teams and stakeholders to implement Government priorities through subordinate legislation.
- Lead editorial and quality assurance processes for legislative instruments.
- Contribute to the management and delivery of Treasury's subordinate legislation program.
- Lead significant drafting work and legislative projects, balancing competing priorities and ensuring work is delivered to a high standard and within required timeframes.
- Support the development of drafting capability within the team through mentoring, coaching and knowledge sharing.
- Contribute to broader team priorities and the delivery of Treasury's legislative program.

Legislation Designers will:





- Lead the design and development of legislative frameworks and solutions to implement Government policy decisions.
- Undertake research and analysis and provide high-quality practical advice and recommendations to resolve complex legislative, legal and policy issues.
- Prepare drafting instructions for primary and subordinate legislation.
- Lead or take responsibility for the preparation of drafting explanatory materials to support legislation.
- Provide strategic and practical advice on legislative design options, risks and implications to inform policy development.
- Work with policy teams, portfolio agencies and other stakeholders to support the development and implementation of legislation.
- Lead or take responsibility for significant components of legislative projects, manage competing priorities and deliver high-quality work within required timeframes.
- Support the capability of less experienced team members through mentoring, coaching, guidance and knowledge sharing.
- Contribute to broader team and Law Division priorities and the effective delivery of Treasury’s legislative program.

Capabilities Required for all Positions:

EL1 employees will be expected to operate under broad direction and exercise a considerable degree of independence, judgement and initiative in delivering complex legislative drafting and law design work.

Applicants should be able to demonstrate:

- Experience leading complex legislative, policy or drafting projects.
- Robust research and analytical skills, including the ability to identify, analyse and resolve complex or sensitive legislative, legal or policy issues.
- The ability to exercise initiative and sound judgement, make decisions within their area of responsibility and identify when significant issues require escalation.
- The ability to manage significant work, balance competing priorities and deliver complex legislative projects with a considerable degree of independence strong written and verbal communication skills, including the ability to communicate complex issues clearly and persuasively to different audiences.
- Strong stakeholder engagement skills and the ability to build and maintain productive working relationships across Treasury and external stakeholders.
- The ability to lead, coach and develop others,



share specialist knowledge and contribute to team capability and continuous improvement.

Desirable skills and experience:

- Tertiary qualifications in law, public policy, economics, commerce or a related discipline, or equivalent experience.
- Experience working with legislation, legislative instruments, legal policy or law reform projects.
- An understanding of the legislative process and the development of legislation will be highly regarded.

For the Legislative Drafter roles, experience drafting legislation or legislative instruments will be highly regarded.

For the Legislation Designer roles, experience developing legislative solutions, legislative frameworks or drafting instructions to implement Government policy decisions will be highly regarded.

Eligibility

Under Section 22(8) of the Public Service Act 1999, employees of the Treasury are required to be Australian Citizens.

Successful candidates will be required to obtain and maintain, at a minimum, a Baseline security clearance, and will be subject to pre-employment screening checks. Some positions may require a higher level of clearance, as specified in the position description.
