International Trade Remedy Focus

As part of the Australian Government’s commitment to a strong and robust anti-dumping and countervailing system, the Department of Industry, Science and Resources (Department) is seeking expressions of interest from persons who would like to be considered for appointment as Senior Member of the Anti-Dumping Review Panel (Review Panel) for a period of up to three years. The Review Panel reviews certain anti-dumping decisions made by the Minister and the Commissioner of the Anti-Dumping Commission under Part XVB of the Customs Act 1901 (the Act). The Review Panel’s work is complex and technical, requiring the application of administrative law principles to specialised trade remedies matters.

The Review Panel supports the integrity of Australia’s trade remedies system by ensuring review outcomes are independent, legally sound, timely, consistent and accessible.

Each review is conducted by a single Member or the Senior Member, who exercises independent judgment and produces fair, objective and well-reasoned reports or decisions in accordance with the Act, administrative law principles and best-practice merits review decision-making.

The Review Panel operates in a demand-driven environment. It must support efficient, accessible and timely review processes for participants in Australia’s trade remedies system.

Senior Member Role Description

The Australian Government is seeking an outstanding leader with sound judgment, demonstrated independence and relevant specialist expertise for appointment as Senior Member of the Review Panel. The Senior Member is a key statutory leadership role, combining independent merits review responsibilities with leadership of Review Panel practice, quality, capability and effective review operations. The Senior Member has statutory responsibilities for allocating reviews and approving application forms. In addition, the Senior Member undertakes independent reviews of decisions made under Part XVB of the Act.

Working closely with the Secretariat and the Department, the Senior Member leads the overall business of the Review Panel and supports efficient, effective and timely review operations. The Senior Member sets transparent practice expectations, promotes consistent and fair review processes, and provides intellectual leadership on best-practice merits review decision-making.

The Senior Member also supports the quality and defensibility of Review Panel decisions and reports, including by conducting or arranging appropriate peer review before publication. The role requires the capacity to promote high standards of analysis, procedural fairness, reasoning and consistency across the Review Panel’s work.

Selection Criteria

A. Qualifications,



knowledge or experience To be eligible for appointment to the Review Panel, the successful candidate must have qualifications, knowledge or experience that satisfy the statutory appointment requirement under section 269ZP(4) of the Act. This may include, but not be limited to, qualifications or substantial experience in law, economics, commerce, public administration, trade remedies, regulation, tribunal practice or complex administrative law decision-making. B. Senior leadership and governance experience The successful candidate will have significant senior leadership experience, a strong understanding of effective organisational governance, and the capacity to perform and deliver the Senior Member’s statutory functions under the Act. They will be able to support best-practice merits review decision-making, promote consistent, fair and timely review processes, support the development and performance of Panel Members, and lead the broader procedures and operations of the Review Panel.

C. Integrity, independence and accountability The successful candidate will exemplify the highest standards of integrity, impartiality and accountability, and demonstrate the ability to embed and promote these standards in a statutory decision-making environment.

D. Specialist expertise

Demonstrated capacity to understand and assess complex factual, economic, legal and procedural issues in anti-dumping, countervailing or comparable regulatory matters. Direct experience in Australia’s trade remedies system would be highly regarded.

E. Merits review decision-making The successful candidate will have demonstrated expertise in making, reviewing or advising on complex administrative decisions. They will be able to apply procedural fairness, assess evidence, identify relevant considerations, reason transparently and produce clear, objective and defensible written outcomes.

F. Communication and report writing The successful candidate will have excellent written and oral communication skills, including the ability to explain complex issues clearly, produce well-structured written reasons, reports and advice, and engage constructively with parties, Panel Members, departmental officials and other stakeholders.

G. Delivery in a statutory environment The successful candidate will have demonstrated ability to lead and manage work in a demand-driven statutory environment,



including by balancing competing priorities, managing sensitive matters and delivering high-quality outcomes within statutory, procedural and administrative timeframes.

Eligibility

Eligible applicants must have the ability to obtain and maintain a minimum of a Baseline security clearance (this includes being an Australian Citizen).
