About the Position
n
We areseeking an experienced
AssistantDirector,RegulatoryInvestigationsandEnforcement(RIE)tojoin
our Registered Organisations Services Branch (ROSB). Workingin a dynamic and cohesive environment, the
AssistantDirector,RIE,will
contribute to the Fair WorkCommission's (the Commission's) regulatory functions by
assistingourDirector,Executive
Director,RIE,and theBranch, to manage the multi-
disciplinarycomplexinvestigationsandrulesteams.
n
As AssistantDirector, you will provide high quality,
consistentandtimelyadvice
relating to the General Manager'sregistered organisations regulatory functions undertheFair Work (Registered Organisations) Act****.You will work collaboratively across the ROSB tocontribute proactively to positive compliance outcomes and behavewith integrity, enabling you to build trust and communicate withinfluence.
n
You willefficiently manage a multi-disciplinary team of lawyers andinvestigators (and potentially other specialists) who
investigatepotential
contraventions
offinancialmanagementobligations
by registered organisations, and theirofficers and employees.
n
Wherenon-compliance has beenidentified, you will manage anyrelevant enforcement actions taken by the General Manager with aview to promoting the productive management of
registeredorganisations
and the delivery ofhigh
standardsofaccountability
to their members.

Legalqualifications
and litigation experience,
includingbriefingexternal
law firmsin a




regulatoryenvironment,are
preferrednoting that this role isprimarily focused on management.
n
Duties
n
Reporting tothe Director, RIE, ROSB, the duties of the Assistant Director, RIEinclude, but are not limited to:
n
n
Leadingand managing the conduct of civil penalty litigation againstregistered organisations, their officers, and employees, thatshape the law and deter non-compliance with the RO Act. Thisincludes briefing solicitors and supporting counsel torepresent the General Manager in the FederalCourt.
n
Managingthe provision of in-house legal advice relating to the GeneralManager's regulatory functions and powers under the RO Act inrespect of the regulation of registered organisations.
n
Managinga small multi-disciplinary team, including lawyers, advisorsand investigators, to investigate complex allegations ofregulatory non-compliance by registered organisations and theirofficers and staff.
n
Advisingon, preparing for, and supporting the General Manager'sinvestigative and enforcement powers, including
compulsoryinformation
gathering powers, and the appropriate use ofinfringement notices, enforceable undertakings, and civilpenalty litigation.
n
Developing investigationand enforcement strategies and internal and external policy andresources to support the functioning of the branch.
n
Drivingefficiencies




and operational performance including with respectto innovative or novel processes to promote the effective andtimely operation of the Complex
Investigationsfunctions.
n
Workingwith a collection of stakeholders across a range of areaswithin the branch, the Commission, the legal profession, theCourts, other government agencies, and the wider publicsector.
n
Otherduties as directed by the Director, RIE, ROSB.
