Own and continually improve MONFINA's compliance framework so the financial services business operates within AFSL ******, meets its obligations to retail and wholesale clients, and identifies, escalates, reports and remediates issues promptly. This is a hands-on second-line role with direct access to the accountable executive and escalation access to the Board. You will work across governance, monitoring, complaints, reportable situations, regulatory change, representative supervision, product and disclosure controls, and financial crime compliance.
Key responsibilities
Maintain the obligations register, compliance plan, monitoring program, regulatory calendar and authorisation matrix; test that services, products, representatives, marketing and business changes remain within AFSL ******
Maintain controls that distinguish factual information, general advice and personal advice; prevent personal advice unless and until separately authorised; restrict derivatives activity to permitted hedging purposes; and verify retail or wholesale client classification
Advise the business on conduct risks, customer outcomes and the practical application of the general licensee obligations, licence conditions and financial services laws
Conduct onboarding and ongoing due diligence for employees, contractors and authorised representatives; maintain appointment, authorisation, training and competence records; and deliver a risk-based monitoring and file-review program
Support the Responsible Manager framework, competence mapping, continuing competence evidence, succession planning and ASIC notifications,



while ensuring day-to-day management coverage aligns to the licence authorisations
Operate conflicts, gifts, benefits, outside interests and related-party registers; review remuneration and incentive arrangements; and ensure conflicts are avoided, controlled or disclosed appropriately
Maintain the incident and breach register; coordinate investigations, significance and reportability assessments, legal input, root-cause analysis, ASIC Regulatory Portal lodgements, remediation and closure verification within required timeframes
Oversee internal dispute resolution under RG 271, complaint recording and response timeframes, IDR data reporting, AFCA membership and cases, systemic-issue identification and consumer remediation
Review Financial Services Guide or website disclosure information, general advice warnings, product disclosures, customer terms, scripts, digital journeys and advertising for accuracy, balance and consistency with the licence and applicable law
Prepare concise compliance dashboards and committee papers; track actions; coordinate with external legal advisers and the AFS auditor; and manage accurate, timely regulatory notifications and information requests
About you
At least five years' relevant compliance, legal,



risk or assurance experience within an Australian financial services business, with meaningful exposure to an AFS licensee
Strong working knowledge of Chapter 7 of the Corporations Act ****, the ASIC Act, the AFS licensee general obligations and relevant ASIC regulatory guidance
Demonstrated experience with compliance monitoring, breach and reportable-situation assessment, complaints, remediation, representative supervision and Board reporting
Experience applying retail and wholesale client rules, general-advice boundaries, disclosure obligations and product or distribution controls
The confidence and judgement to challenge constructively, document a defensible position, escal...
Transparent written and verbal communication, strong attention to evidence and deadlines, and the ability to turn legal requirements into workable processes
A relevant tertiary qualification in law, commerce, finance, accounting, risk, compliance or a comparable discipline, or equivalent senior industry experience
Australian work rights and willingness to complete consent-based reference, qualification, probity and regulatory background checks relevant to the role
