The Opportunity An opportunity has become available for an admitted lawyer to join a specialist property settlements team working across mortgagee sales, secured property transactions and lender-side matters.
This is a hands-on property role offering exposure to transactions across Australian jurisdictions, with responsibility for managing conveyancing matters from initial instruction through to settlement.
Sitting alongside an established mortgage recovery practice, you will also work closely with recovery lawyers on the property aspects of enforcement matters, providing an interesting combination of traditional property work and specialist mortgagee transactions.
The Role
You will manage a varied property settlements workload, including:
- Managing conveyancing transactions from commencement through to settlement.
- Preparing and reviewing contracts for the sale of property.
- Acting on mortgagee in possession sales.
- Conducting property due diligence and preparing title reports.
- Managing electronic settlements through PEXA.
- Facilitating transfers of title and other settlement requirements.
- Drafting and reviewing leases, licences, assignments and other property documentation.
- Negotiating terms associated with property transactions.
- Advising on issues arising throughout the conveyancing and settlement process.
- Dealing with caveats, including lapsing and extension requirements.
- Assisting with GST and land tax issues arising in mortgagee transactions.
- Liaising with councils, strata managers, agents, clients and other relevant authorities.
- Providing property law support to lawyers working across mortgage recovery and enforcement matters.
You will have ownership of your files and regular interaction with clients and external stakeholders, while working closely with experienced lawyers across the broader practice.
About You
You will be an admitted Australian lawyer with practical experience in property, conveyancing or settlements and the confidence to manage transactions with a high degree of autonomy.
Ideally, you will bring:
- Experience managing property transactions from start to finish.
- Strong working knowledge of PEXA and electronic settlements.
- Experience preparing and reviewing contracts for sale and associated property documentation.
- A sound understanding of title and due diligence requirements.
- Strong organisational skills and the ability to manage a busy file load.
- Excellent written and verbal communication skills.
- A practical, detail-oriented and client-focused approach.
Experience with mortgagee in possession sales, caveats, land tax, GST implications or secured lending matters would be particularly advantageous.
