Established in 1979 by the Ballarat Aboriginal community in the Ballarat district, BADAC’s vision is to be the strongest voice and presence in the Ballarat area, supporting and respecting their people, enhancing our community, growing their culture and honouring their heritage. BADAC is the Aboriginal Community-Controlled Organisation (ACCO) for the Ballarat and District area, covering 4 local government areas (LGAs). The organisation is extremely proud of the contribution and support they have provided the local Aboriginal community over the past 40 years deliveringinga comprehensive range of health, social, welfare and community development programs to local Aboriginal people.

The Role
Reporting to the Human Resources Manager (HR Manager) and Human Resources Team Leader (HR Team Leader), the Senior Human Resources Officer will be accountable for conducting high quality, professional and timely investigations of allegations of workplace misconduct and is the focal point of contact for the Workplace Relations (WR) & Industrial Relations (IR) matters in consultation and escalation to the HR Manager and Team Leader.
The incumbent will provide advice to managers and employees regarding the prevention and resolution of grievances, union consultation, performance management processes, employment legislation and award provisions.
The Senior HR Officer will need to be a solid team player with a demonstrated commitment to problem solving and resolving workplace issues in a timely manner and to a high standard. The Senior HR Officer will need to have a high standard and practice of ethical conduct and behaviour and will adhere to the BADAC’s Code of Conduct and relevant policies and procedures.
The Senior HR Officer will need to be highly motivated, enthusiastic and possess a sound knowledge of Aboriginal culture and an ability to communicate effectively with all stakeholders.
Key Duties & Responsibilities:
- Assisting the HR Team Leader (TL) & HR Manager in investigating and managing with Employee Relations issues including but not limited to employee grievances and workplace grievances including those relating to bullying, harassment, victimisation, discrimination, complaints, conflicts and misconduct through:
- Undertaking formal investigations into allegations and making recommendations on appropriate outcomes from investigations.
- Maintaining a high level of familiarity with the organisation’s policies & procedures
- Ensuring consistent, timely and comprehensive investigations.
- Monitoring the welfare of all parties subject to an investigation process; collaborating with support functions.
- Offering confidential advice to all staff regarding workplace behaviours.
- Applying principles of natural justice to ensure a fair process for all;
- Communication and engagement with relevant parties throughout the investigation process, with respect to confidentiality requirements.
- Recommending appropriate activities to aid resolution via population of the investigation report.
- Maintaining relevant human resources records, information and databases to ensure accuracy and availability of information where required.
- Support the HR TL / HR Manager in the management of industrials matters.
- Assist HR Manager / Chief Human Resources & Governance Officer (CHRGO) in advocacy and negotiations with unions and other external bodies when required.
- Assist HR TL / HR Manager in preparing new Enterprise Bargaining Agreement documentations when required.
- Provide written and verbal advice on general industrial matters and escalation to any matters to HR TL / HR Manager.
- Monitor organisational change processes and provide proactive advice to HR TL/ HR Manager to mitigate the risk of industrial disputes and ensure compliance with organisational policies.
- Assist in handling day-to-day enquiries from employees and managers regarding Human Resources policies, procedures advice on the interpretation of awards and legislation and the application of industrial instruments as required.
- Assist/ manage HR projects as required by HR TL / HR Manager.
- Always maintain strict standards of confidentiality and act in a professional manner in accordance with the policies and procedures of BADAC.
- Carry out other duties as directed by the Human Resources Manager and HR Team Leader as required.
Key Selection Criteria:
- Strong knowledge of Aboriginal culture and the ability to communicate effectively and sensitively with Aboriginal people.
- Relevant degree in human resources and previous relevant experience in a HR Generalist position with 3-5 years of Employee/Industrial Relations experience.
- A proven record in providing legally compliant and specialist workplace relations advice.
- Demonstrated experience in undertaking workplace investigations in an empathetic and sensitive manner.
- Demonstrated understanding of relevant legislation including but not limited to the Fair Work Act 2009 (Cth), Occupational Health and Safety Act 2005 (Vic) inter alia.
- Demonstrated experience in providing advocacy and support on a range of workplace and industrial relations matters.
- The ability to work independently, prioritise work demands and to manage confidential and sensitive matters.
