Position: Commercial Manager Reports to: Development Director, Herston Quarter Business Line / Function: Australian Unity – W CM Social Infrastructure – Herston Quarter Team Size 2 Budget Controlled: TBA PRIMARY OBJECTIVE: The Commercial Manager will provide strategic expertise and management to support delivery of the $2.0 billion Herston Quarter Redevelopment.
KEY ACCOUNTABILITIES: Key accountabilities required to achieve the primary objective of the position: Key Accountability Performance measures Management of commercial agreements Key point of contact for commercial matters as they arise across the project.
Manage the commercial interface between the project team and Metro North Hospital and Health Service's Commercial, Property Development team overseeing the project on behalf of the State of Queensland.
Direct the commercial project management of Development Agreement activities including Stage Commencements, Stage Completions, and Critical Milestones.
Collaborate with the Development Director and the project team on commercial matters related to new stage development activities, construction contracts and financiers.
Manage external negotiations and provide internal strategic guidance to the project team on project outcomes with development partners, builders, contractors, Government agencies, local government municipalities and other stakeholders.
Manage internal and external project inputs and outputs including, the legal outcomes for the project.
Direct project staff, consultants and contractors in the successful delivery of project outputs.
Lead the establishment of processes and the development of tools to ensure commercial activities and project milestones are proactively monitored and reported against targets, including meeting with project team members and government partners to identify and resolve issues in a commercially sensitive and timely way.
Establish and build relationships with multiple parties, including key government partners, contractors and peers to assist the achievement of commercial outcomes.
Lead the establishment and implementation of precinct wide contracts and documents, including procurement, acceptance and preparation of building, facility management and service contracts.
Manage the maintenance of contract registers and lead the establishment of processes to monitor key contract milestones, such as conditions, expiry dates, approvals, scope limits and changes.
Undertake high-level negotiation on contract terms or other commercial matters adopting a practical, solutions based approach to resolving and concluding those matters.
Oversee the preparation of notices and other correspondence required by the project team or the Development Director in connection with the management of the various commercial agreements including construction contracts, financier deeds and other related agreements.
Identify, manage and mitigate contractual risks for the project.
Strategic commercial support Oversee the development of specific project plans in conjunction with the commercial and development teams.
Comprehensive knowledge and understanding of complex commercial agreements, including the Development Agreement, construction contracts and stage delivery agreements.
Oversee the preparation, negotiation and finalisation of service agreements with consultants, operational service providers and tenants of leased accommodation.
Provide strategic commercial advice to the project team on the Development Agreement as it relates to contractual project requirements and operational matters.
Support multiple stage developers with contract management and strategic commercial advice.
Risk Management Actively manage risks by systematically identifying, analysing, evaluating and treating risks that may impact on project objectives.
Regularly monitor, review, consult and communicate project risks to senior management.
Reporting Reviewing the monthly PCC, PCG, risk management and Steerco reports to management on the performance of Herston Quarter and recommends strategies for addressing any key risks and opportunities.
Oversee the preparation of notices and reports required under the Development Agreement and related documents.
Coordinate the preparation of project reporting requirements.
Ensure procurement and contractual agreements are compliant and managed.
Collaborate with the Development Director, Project Financial Manager, AU corporate financial team and AU Treasury to ensure financial compliance and reporting requirements are met.
Leadership / Compliance / Governance / Workplace Health Safety Leadership and management of Commercial Team staff.
Oversight of records management for the project team.
Manage implementation of systems and processes to ensure adherence to all relevant risk and compliance obligations.
Oversee monitoring of all insurances required to be held by the various consultants/contractors are current and comply with contractual requirements, and maintain an accurate insurance certificate register.
Oversee monitoring of compliance and report upon time related contractual obligations.

In-depth understanding of contractual agreements in relation to property development, construction and or facilities management.
Demonstrated ability in consultant and contract management Establishing and administering service agreement contracts with multiple providers.
Enforcing and auditing procurement process to ensure requirements are met.
Experience in the development, construction and or property and facilities management sector.
Expert negotiation and conflict resolution skills Experience in the development, construction and or property and facilities management sector.
Demonstrated high level attention to detail and strong communication skills (oral and written).
Demonstrated ability to support a project and work in teams to deliver project outcomes.
Qualifications Minimum of 5 years' experience in a comparable senior role in construction, development, infrastructure or related areas.
A degree in either business, commerce, law, engineering or construction management.
Specific performance indicators will be determined for the position annually.
