What do you say to the person who is clearly burning out, when the policy document has nothing helpful to offer either of you?
Most HR leaders already know that moment. It is not a training gap. It is a leadership gap, and the law has just made it a legal one too.
Across Australia, psychosocial hazards, things like bullying, unmanageable workloads, fatigue and chronic stress, now carry the same legal seriousness the law has always demanded for physical safety. Western Australia and Queensland moved first, South Australia followed, and Victoria's regulations commenced in December 2025. It is no longer a wellbeing initiative. It is a duty of care in every state.
SafeWork NSW has deployed 20 specialist psychosocial health inspectors, and from 1 July 2026, the Managing Psychosocial Hazards at Work Code of Practice became a legally enforceable benchmark in NSW. Recent case law has confirmed that a single employee's complaint can be enough to trigger scrutiny of an organisation's entire system, not just one team.
Most organisations know the law has changed. Far fewer have worked out what it actually asks of their leaders, day to day.
Step forward as a Psychosocial Safety Fellow, not just to observe the future, but to help build it. This is a call for visionary HR leaders: to inspire, to be inspired, and to leave a legacy that shapes how leadership is practiced for generations to come.
