The Specialist Advice and Services Division (SASD)

The SASD is the ACCC's in‐house provider of specialist services, including legal and economic services across the ACCC. SASD team members are located in Canberra, Melbourne, Brisbane, Adelaide, Perth, Hobart, Darwin, Sydney and Townsville.

Legal units

/n

/n

- Competition and Consumer Law Unit (CCLU) supports the Competition Division, Consumer and Fair Trading Division, and enforcement activities of other divisions such as the Consumer Product Safety Division.

/n

- Mergers and Exemptions Law Unit (MELU) supports the Mergers and Exemptions Assessment Division.

/n

- Regulatory Law Unit (RLU) supports the Infrastructure Division, Digital ID Division, Scams Prevention and Digital Markets Division, and the Consumer Data Right Division.

/n

- Corporate Law Unit (CLU) supports the Corporate Division, Consumer Product Safety Division (non‐enforcement), National Anti‐Scams Centre, as well as whole‐of‐agency corporate governance, integrity, employment, privacy, intellectual property, procurement, and Freedom of Information matters.

- Legal Counsel Unit provides support across Divisions on matters of highest significance.

Key duties of the position

/n

It is an exciting time to join the ACCC's legal function – with plenty of current and complex legal frameworks to help implement such as the new merger regime and the world‐leading scams prevention framework.

/n

There are currently multiple ongoing and non‐ongoing positions available in the ACCC's legal units.

/n

As a Lawyer, you will

/n

/n

- Conduct some independent work, and mostly supervised work.

/n

- Assist and seek input from senior team members.

/n

- Develop and maintain professional relationships at all levels within the ACCC to assist SASD to provide a responsive client service.

/n





- Provide strategic legal advice on the ACCC's functions and powers under relevant legislation (including the Competition and Consumer Act 2010, the Telecommunications Act 1997, the Digital ID Act 2024, the Water Act 2007).

/n

- Draft or settle compulsory information notices, undertakings, notifiable or legislative instruments, and other legal documents.

/n

- Provide legal input to statutory decisions such as merger assessments, authorisations and exemption decisions, public inquiry reports and guidance documents and other publications.

/n

- Provide legal (and legal policy) advice on law reform matters relevant to the ACCC's remit, powers or functions.

/n

- Conduct legal and related research into complex matters relevant to ACCC responsibilities under relevant legislation.

/n

- In some teams, assist with the conduct of investigations and the performance of the ACCC's compliance and enforcement functions. This includes advising on the use of statutory investigation powers.

/n

- In some teams, assist with the management of Court and Tribunal proceedings. This includes both enforcement proceedings and proceedings arising from the ACCC's merger, exemptions and regulatory functions. Responsibilities include drafting or settling court documents (including pleadings and submissions) and other documents in support of litigation.

- In CLU, provide legal advice on complex and/or high‐risk governance, employment, information‐handling, privacy, contract and procurement issues.

Eligibility

/n

- All candidates are expected to meet the APS Integrated Leadership Profile (ILS) for the classification advertised. This role in particular requires admission as a practitioner, however described, of the High Court or the Supreme Court of an Australian State or Territory, or the ability to become so admitted before commencing in the role.

/n

- Post‐admission legal experience (typically 1–2 years (APS5) or at least 2 years (APS6)) as a legal practitioner in the following areas relevant to the role(s) you are applying for: CCLU – Competition and consumer law enforcement functions and litigation; MELU – Merger assessment and exemption administrative decisions, competition law and litigation; RLU – Administrative decision‐making, regulatory, digital, competition, consumer or enforcement matters; CLU – Corporate law, corporate governance, employment, privacy, intellectual property.

- Experience of all areas is not required, but candidates must have a willingness to work across a range of matters.

/n

- Ability to work collaboratively and build stakeholder relationships.

/n

- Effective communication skills, including ability to deliver legal advice clearly.

/n

- Demonstrated ability to understand complex legal frameworks and / or adapt to new technical content.

Getting to know the Australian Competition and Consumer Commission

/n

The ACCC is an independent statutory authority that administers the Competition and Consumer Act 2010 and other Acts. The ACCC works to promote effective competition and fair trading in the market place to benefit consumers, business and the community, and efficiency in the delivery of certain infrastructure services.

The AER is a part of the ACCC and handles Australia's national energy market regulation with an independent board, sharing employees, resources and facilities with the ACCC.
