What you will do as the Senior Investigator, Senior Compliance or Project Officer: TheConsumer and Fair Trading Division aims to protect the interests ofconsumers and support fair trading in markets affecting consumersand small business. It does so by delivering compliance andenforcement outcomes under the Australian Consumer Law (ACL), whichforms part of the CCA. Consistent with this aim the Division alsohas responsibility for the ACCC’s specialist agriculture, smallbusiness and industry codes functions.

TheDivision has primary responsibility for consumer and fair tradinginvestigation, compliance and enforcement activities carried out bythe ACCC under the CCA. This includes delivering a range of broadercompliance initiatives to address or prevent misconduct in the market and enhance consumer and business welfare. TheDivision also contributes to the stewardship of the wider consumerprotection system in Australia through advocacy and law reforminitiatives, and engagement with domestic and internationalagencies.





The Division also contributes to the development ofbroader consumer protection and fair trading through advocacy andlaw reform initiatives. TheDivision has three enforcement Branches - the Consumer andCompliance Strategies Branch, the Retail and Supermarkets Branchand the Small Business and Agriculture Branch - which areresponsible for investigating and resolving potential breaches ofthe fair trading and consumer protection provisions of the CCA,including through litigation. Theenforcement branches support the broader work of the ACCC throughinternal and external stakeholder engagement, shaping policy andproviding advice towards law reform, enforcement capabilitydevelopment for the ACCC and other regulators (national andinternational), and contributing to competition and consumer lawoutreach.

- Beresponsible for managing inputs and contributions to thedelivery of compliance or engagement projects and activities,including planning, monitoring, reporting, research andanalysis.
- Provide advice tosenior management on trends and patterns to support policy andlegislative reform.
- Prepare (and review asappropriate) internal and external documents includingsubmissions, staff papers, notices, undertakings,correspondence, reports, minutes, briefs, and external-facingmaterials, including consumer and industryguidance.
- Contribute to thedelivery of strategic engagement activities with key industry,stakeholder and consumer organisations, including participationin formal discussion and decision-making forums.
- Ensureall your contributions are delivered in line with theCompliance and Enforcement Policy, plans anddirections.
- Workcollaboratively within a geographically dispersed team tomanage joint projects and tasks, including tracking progressand workflow, meeting milestones and deadlines and develop andmaintain effective working relationships and professionalnetworks with internal and external stakeholders. As aSenior Investigator in the Enforcement branches,you will:
- Beresponsible for investigating potential breaches of theconsumer and fair trading provisions of the Competition andConsumer Act 2010 (Cth) (CCA). This may include assessingevidence, interviewing witnesses,



briefing legal advisers aswell as preparing and presenting updates and recommendations tothe Enforcement Committee and Commission.
- Beresponsible for engaging with various external stakeholders,including consumers, businesses, and government agencies, soclear written and verbal communication skills areimportant.
- Possess a good,working understanding of the Competition and Consumer Act2010 (Cth), including the Australian Consumer Law, or theability to quickly attain this understanding.
- Be able to objectively and strategically assess information andpotential evidence in a timely and efficientmanner.
- Be able to identify logical next steps and the most suitable resolution for investigations, including by administrativemeans or by court action and persuasively communicate thereasons for decisions and recommendations.
- Have,or have the ability to obtain, the Certificate IV inGovernment Investigations qualification as set out in thePublic Services Package (PSP) for persons/officers working inoperational roles undertaking government entityinvestigations.

Theseroles in particular requires

- Ademonstrated understanding, or an ability to quickly acquire anunderstanding, of the Competition and Consumer Act2010 and other relevant legislation.

Ademonstrated ability to

- Research, investigateand analyse complex issues, develop solutions, and makerecommendations in line with strategic objectives.
- Communicate clearlyand persuasively in writing and orally to internal and externalaudiences.
- Effectively engage andwork with both internal and external stakeholders to deliveroutcomes.
- Plan,organise and prioritise competing workloads to ensureactivities are delivered in a timely and efficientmanner.
- Guideand develop staff where required. Thefollowing job specific criteria are also highlydesirable:
- Tertiaryqualifications in law, economics, public policy or similarfields. You will beasked to respond to the statement of claims of no more than 800words and submit your resume with key outcomes or what you are mostproud of in each role you have held (2 pages maximum).
